关于如何解决图书馆绝版作品数字化版权问题的研究——以法国版权默示许可制度为例

摘　　要：目前,许多国家的图书馆对所收藏绝版作品的数字化开发利用都受到了版权问题的阻碍。在国际社会解决此问题的立法探索中,法国的版权默示许可制度呈现出公益导向和程序化、垄断性版权集体管理、注重保护权利人利益以及许可程序简便、授权成本低和规模授权等特征。建议我国学习借鉴法国的立法经验,结合国情,构建专门适用于图书馆绝版作品数字化的版权制度。In many countries,libraries’digital exploitation of out-of-print works in their collection is hampered by copyright issues.In the legislative exploration of the international community to solve this problem,France’s copyright implied license features public interest orientation and procedural and collective management of monopolistic copyright,focusing on protecting the interests of rights holders,as well as simple procedures,low costs and economies of scale.It is suggested that China should learn from France’s legislative experience,combine it with China’s conditions to build a digital copyright system for out-of-print works suitable for libraries.
