摘　　要：我国医养结合的养老模式处于初步发展阶段,法律对之缺少相关规范,故成熟的养老体系还未形成——养老及医养结合服务机构所涉养老服务纠纷和医疗侵权纠纷的诉讼不断增多、老年人的权利得不到保障等系列问题引发社会关注。文章探讨了医养结合模式中存在的法律问题,并针对性地提出养老医疗服务方面的法律建议及相关政策的落实、养老机构和医养结合服务机构的监管主体和职责、以法律推进养老医疗服务规范化持续性发展。In China,the combination of medical care and endowment is in the preliminary stage of development.It is lack of legal norms,and has not yet formed a set of mature endowment system.There are more and more lawsuits about pension service disputes and medical infringement disputes in pension service institutions and service institutions combining medical care and endowment,and the rights of the elderly cannot be guaranteed,which have aroused the attention of the society.This paper discusses the legal problems in this mode,and puts forward relevant legal suggestions and implementing policies related with the combination of medical care and endowment,the supervision bodies and responsibilities of pension institutions and service institutions combining medical care and endowment,and the promotion of the standardized and sustainable development of endowment medical services by law.
