专利实现标准垄断化的市场推进路径与模式研究

摘　　要：在市场竞争的背景下,专利技术实现标准垄断化是以市场化为过程、标准为最终归宿的实现和扩散的过程,包括企业涉及专利的事实标准垄断形成过程和联盟涉及专利的事实标准垄断形成过程,是专利技术在市场适用范围内的市场垄断和专利权垄断的双重垄断。通过模仿波士顿矩阵,构建一个以“市场化程度”为横坐标,以“技术水平”为纵坐标的专利实现标准垄断的市场推进模式二维匹配图,认为市场推进专利技术实现标准垄断存在企业技术联盟模式、企业互助联盟模式、超强企业模式以及企业市场联盟模式四种模式。With the increasingly violent market competition,patent technology enters a standard to achieve standard monopoly,it has two paths,one through the enterprise and other through the alliance.Similarly,it can achieve a double monopoly,a market monopoly and a patent monopoly.By mimicking the Boston matrix,this paper constructs a two-dimensional matching graph with"marketization degree"as the abscissa and"technical level"as the ordinate.There are four models,they are leading technology enterprise dominate model,enterprises mutual assistance model,super enterprise model and market leading enterprise dominate model.
