摘　　要：《民法典各分编(草案)》第一百二十九条规定,实行家庭承包的土地承包经营权人依照农村土地承包法的规定,有权出让土地经营权。这是我国首次从立法层面上明确了农户土地经营权可以出让。但与农村土地经营权出让相关法律问题必须明确,相关法律规定有待统一修改,以构建农村土地经营权出让法律体系。According to the Article 129 of the Divisions of the Civil Code(Draft),the land contractual management right holders are entitled to transfer land management rights,which is in accordance with the Rural Land Contracting Law.This is the first time that China has made clear from the legislative level that the land management rights of farmers can be transferred.However,the legal issues related to the transfer of rural land management rights must be clear,and the relevant laws and regulations should be uniformly revised to build a legal system for the transfer of rural land management rights.
