论人格权许可使用合同的法定解除——兼评民法典各分编草案第八百零二、八百零三条

摘　　要：人格权不同于财产权,人格权许可使用合同的法定解除不宜完全适用合同法定解除的一般规则。人格权许可使用合同中,对人格尊严与人格自由的保护应当优先于交易安全和交易效率的保护,不宜出于鼓励交易、维持合同效力等财产法上的目的而严格限制人格权许可使用合同的法定解除条件,人格权人应依法享有任意解除人格权许可使用合同的权利。人格权许可使用合同的法定解除规则既是人格权保护的特殊规则,也是适用于多数人格权益的一般规则,宜规定在民法典人格权编的一般规定部分。Personality right is different from property right. The general rule of legal rescission of contract is not suitable for the legal rescission of personality right licensing contract. In the license contract of personality right,the protection of personality dignity and personality freedom should take precedence over the protection of transaction safety and efficiency. It is not appropriate to strictly restrict the statutory termination conditions of the license contract of personality right for the purpose of encouraging transactions and maintaining the validity of contracts. Personality right holders should enjoy the right of arbitrary termination of the license contract of personality right according to law. The statutory rescission rule of the license contract of personality right is not only a special rule for the protection of personality right,but also a general rule applicable to the majority of personality rights and interests. It should be stipulated in the general provisions of the personality right in the Civil Code.
