自治法规的立法完善与司法适用衔接机制研究

摘　　要：由于实施配套保障机制不健全,民族自治地方自治法规的功能发挥十分有限。自治法规的司法适用对其立法后的修缮有着重要价值:立法目的的实现离不开司法权利救济功能的发挥;立法变通权限的落实需要通过司法的纠纷解决功能予以确认;立法后的实施与完善与司法的监督功能联系紧密。应构建一套有利于自治法规立法完善与司法适用良性互动的长效机制,即以自治法规立法备案信息的适度公开为保障,以立法解释回应功能的充分发挥为依托,促使自治法规的修改与司法适用的反馈相衔接。Defective supporting guarantee mechanism breed limited play of the autonomous laws and regulations in national autonomous areas.Judicial application in autonomous laws and regulations is of great value to subsequent renovation of legislation.Realization of legislative goal goes hand in hand with the sound play of the relief function of judicial rights.Implementation of legislation flexibility needs to be confirmed through judicial dispute resolution function.Implementation and improvement subsequent to legislation is closely related to judicial supervision function.Therefore,efforts should be made to develop a long-term mechanism,which is conductive to positive interaction between autonomous legislation improvement and judicial application.Namely,efforts should be made to promote cohesion and coherence between revision of autonomous regulations and the feedback of judicial application with proper openess of filed information of autonomous laws and regulations as a guarantee and legislative interpretation response function as basis.
