我国农民工工伤保险法律问题研究及对策分析

摘　　要：农民工是时代缩影下的一个特殊群体,为我国现代化、城镇化建设贡献自己的力量。但其作为劳动者,在社会保障待遇尤其是工伤保险方面的享受却未尽如人意,究其原因主要在于:现有立法体系不完善,工伤认定不够专业且程序烦琐,先行支付制度力有不逮,重补偿、轻预防和康复阶段。工伤保险事关农民工的切身利益,亦关社会的和谐稳定。因此有必要围绕健全立法体系,塑造专业、高效的工伤认定,完善先行支付制度,强化工伤模式中的预防和康复这四个方面来为农民工后续务工减轻后顾之忧。Rural migrant workers are a special group in the new times,contributing their own efforts to China's modernization and urbanization construction.However,as workers,their social security benefits,especially those of work-related injury insurance,are not that satisfactory,the main reasons are as follows:the existing legislative system is not satisfying;industrial injury identification is not professional and application procedures are cumbersome;the advance payment system has much to be desired;relatively more stress is put on compensation,instead of prevention and rehabilitation.Work-related injury insurance is closely related not only to the immediate interests of rural migrant workers,but also to social harmony and stability.Therefore,it is necessary to focus on the construction of legislative system and a professional and efficient identification procedure of work injury,to improve the advance payment system,and to attach more importance to the prevention and rehabilitation regarding the work injury so as to relieve rural migrant workers'worries in the follow-up work.
