法律文义解释的逻辑程式建构

摘　　要：法律文义解释经受法律规则运用语境中的法律实践、法律经验相互交融产生的事实影响。基层司法者适用法律规则的实践,处在基层方言语境之中,法律实践与经验交融的力度更大,这种状况决定顶层设计为主的法律规则必须沟通于公众的日常社会生活,法律文义解释必须接乡土地气。法律文义解释在判断法条要件、解释推论前提、扩张法律概念、认定交融事实、完成要件归入的裁判思维过程中完成。法律理解、解释与适用应积极对社会行为进行评价,引导公众发自内心的自愿接受法律规则。The interpretation of the meanings of laws is affected by the blend of the legal practice,and legal experience in the language circumstance of the legal rules.The grass-root legal workers should adapt to the practice of legal rules,they are in the circumstance of grass-root dialect,their legal practice and experience are greatly blended,this determines that the legal rules of top-level design must be communicated with the daily social life of the public,and the interpretation of legal meaning must take care of the land spirit of the hometown.The interpretation of the meanings of laws is completed in judging thinking such as the judgement of legal elements,the interpretation of legal`premises of inference,expanding legal concept,and judging the blended facts,the completion of element subsuming.The comprehension,interpretation,and adaption should actively comment on the social activities,guide people to accept the legal rules willingly from their bottom of heart.
