摘　　要：我国《继承法》实行无条件的限定责任继承,没有把依法制作遗产清单作为实行限定责任继承的首要前提条件,这有可能导致侵害遗产债权人的利益,也有可能损害其他继承人的利益。通过考察遗产清单制度的起源与功能,分析我国立法的现状与不足,在比较评析国外遗产清单制度立法内容的基础上,结合我国实际,借鉴域外立法经验和汲取我国学者的有益观点,提出我国《民法典继承编》之遗产清单制度的立法构想。The Inheritance Act of liability for satisfaction of estate debts is unconditional limited inheritance that preparing inventory is not as the prerequisite for carrying out limited inheritance,which may lead to the infringement of the interests of the estate creditors and the other heirs.Through the study on the origin and function of the inventory system,analyzing the present situation and deficiency of the legislation of our country,on the basis of comparative studies on the inventory system in foreign succession law,and combining with the reality of our country,drawing lessons from the experience of foreign succession law and drawing the useful views of the Chinese scholars’suggestion,this paper puts forward the legislative conception of the inventory system in the succession law of Civil Code in our country.
