基于B2B2C的专利侵权假冒协同保护模式探讨

摘　　要：在“大数据”和“互联网+”的背景下,中国电子商务已逐步发展为“平台+大数据+金融”的B2B2C模式。在这一形势下,电子商务平台的专利保护也将迎来新的挑战与机遇。本文基于对淘宝网购平台专利产品的抽样调查,深入剖析中国电子商务平台专利侵权与假冒的现状,从实施主体、保护方式、保护动机维度提炼出中国电子商务领域主要的专利保护模式并作对比分析。基于协同理论,结合B2B2C模式的结构特征与运行特点,提出一个包括数据挖掘与获取、数据整合、数据分析、数据共享、整改处罚以及激励资金注入的G2I2C专利协同保护模式。Against the backdrop of“big data”and“Internet+”,E-commerce in China is gradually approaching to the B2B2C mode,combining platform,big data and finance.In such a situation,the patent protection of E-commerce platform will also face new challenges and opportunities.Based on the sample survey of patent products purchased on taobao,the paper analyzes in-depth the current situation of patent infringement and counterfeiting on online shopping platforms in China,generalizes the main protection mode from the dimensions of implement subjects,protection modes and motivation,and makes comparative studies thereof.Based on the synergistic theory and take into consideration of the characteristics of B2B2C mode,the paper proposes a collaborative patent protection mode called G2I2C,which incorporates data mining and acquisition,data integration,data analysis,data sharing,recti fication punishment and incentive capital injection.
