农村宅基地使用权收回制度的缺陷与立法回应——基于《土地管理法修正案(草案)》的思考

摘　　要：《土地管理法修正案(草案)》征求意见稿已经发布,其对于现行《土地管理法》第六十五条几乎没有触及。现行《土地管理法》第六十五条对于宅基地使用权收回的规定存在着收回情景不明确、收回程序缺位、补偿标准模糊等缺陷。《土地管理法修正案(草案)》应该在宅基地的收回情景、收回程序、收回补偿等方面进行补充和完善。The draft of the Amendment(Draft)to the Land Management Law has been published,which hardly touches on Article 65 of the current Land Management Law.The provisions of Article 65 of the current Land Management Law on the recovery of the right to the use of homestead have some defects,such as unclear recovery scenario,absence of recovery procedures and vague compensation standards.The Draft Amendment to the Land Management Law(Draft)should be supplemented and perfected in such aspects as the situation,procedure and compensation for the recovery of residential land.
