摘　　要：我国刑法上的强奸罪基于传统女性为弱势群体的观念设立,如今随着女性地位的不断提升,传统保守的性观念以及人们对性的认知都发生了巨大的变化。对于强奸罪在新的时期犯罪形式发生的新变化我国在相关立法方面显得有些“迟钝”和保守,法律关于性权利的保护还处于空白地带,这使得很多的性犯罪受害者成了真正的弱势群体。近年来对刑法的几次修正中都未涉及强奸罪,因此,如何更好地完善强奸罪的立法规定,弥补法律有关性权利保护方面的漏洞,真正体现男女从法律形式上的平等向实质平等的转变,仍需思考。女性是否可纳入强奸罪的主体范围、男性是否能成为强奸罪所保护的对象、婚内强奸是否应罚、“性交”定义如何扩大以适应时代变化等,对这些问题的探讨具有现实意义。The crime of rape in China’s criminal law is based on the traditional concept of women as a vulnerable group,now the traditional concept of sex and people’s understanding of sex has undergone tremendous changes with the continuous improvement of the status of women.As for the new changes in the forms of rape in the new period,our country seems to be somewhat slower and conservative in the relevant legislation,and the protection of sexual rights in the law is still blank,which makes many victims of sexual crimes become truly vulnerable groups.Moreover,in recent years,several amendments to the criminal law have not dealt with the crime of rape,so we need to consider how to improve the legislative provisions on rape,to complement the loopholes in the legal protection of the law so that it can truly reflect the change of the equality between men and women from the legal form to the substantive equality.The following issues,whether the main body of rape should include women,whether men can be protected in the crime of rape,whether marital rape is punishable,how to extend the definition of sexual intercourse to adapt to the change of the times and so on,are of practical significance.
