以审判为中心的刑事诉讼制度改革对贩卖毒品案件侦查的影响及应对

摘　　要：从分析以审判为中心诉讼制度改革的本质和要求入手,对照剖析当前贩卖毒品案件侦查工作中存在的主要问题是:对口供依赖程度高、调查取证活动不规范、侦查手段相对落后以及采取技术侦查措施所收集的证据不符合法庭质证要求。为积极适应改革,公安机关应当革新侦查理念和调查取证方式,逐步建立大数据情报共享体系,并规范采取技术侦查措施所收集证据的开示条件及程序。Starting with the analysis of the essence and requirements of trial-centered reform of criminal procedure system,this article points out that the main problems existing in the investigation of drug trafficking cases are the high dependence on confession,the lack of investigation and evidence collection standards,the relatively backward investigative methods and the fact that the evidence collected by technical investigative measures does not meet the requirements of cross-examination.In order to actively conform to the reform,the public security organizations should innovate the concepts and ways of investigation and evidence collection,gradually establish a big data information sharing system and standardize the conditions and procedures of the evidence collected by technical investigation measures.
