高校规范性文件法治化的诉求

摘　　要：高校规范性文件是高校行使公共权力的重要依据,是现代大学治理的制度载体。高校规范性文件只有契合法治化诉求,才可以为依法治校奠定规则基础,才可能促进高校治理体系和治理能力现代化。高校规范性文件法治化须满足形式法治、程序法治和实质法治等三方面的要求。形式法治在名称、形式、签署、格式、遣词造句、结构等技术性角度对高校规范性文件进行规范,程序法治在程序阶段及基本正当性程序制度贯彻方面对高校规范性文件进行规范,实质法治在内容方面对高校规范性文件进行规范。Normative documents of colleges and universities,as an important basis for such colleges and universities to exercise public power,are institutional vehicles for modern universities governance.Only when the normative documents of colleges and universities conform to the demand for rule of law,can they lay rule basis for law-based governance and promote the modernization of the governance system and capabilities of colleges and universities.The rule of law in the normative documents of colleges and universities must meet the requirements of formal rule of law,procedural rule of law and substantive rule of law.The formal rule of law requires regulation of normative documents of colleges and universities from the technical perspectives such as name,form,signature,format,words and sentences and structure.The procedural rule of law requires regulation of normative documents of colleges and universities from perspectives of the procedural stage and the implementation of basic due procedures.The substantive rule of law imposes regulation of normative documents of colleges and universities from the perspective of content.
