我国辣椒新品种保护及DUS测试现状

摘　　要：我国农业新品种保护体系已经初步建立,相关法律法规逐步完善。辣椒作为申请量与授权量最多的蔬菜,2000—2018年新品种累积申请量380份、授权量101份,分别占蔬菜总申请量和总授权量的16.4%和14.9%。我国辣椒DUS测试指南已制定完成,并发布了行业标准和操作手册。通过对辣椒新品种育种现状与趋势进行简要概述,并对辣椒新品种保护现状及DUS测试技术标准进行说明分析,针对辣椒新品种同质化问题、一致性问题、品种权保护力度及DUS测试指南的性状描述与操作性提出问题及建议,进而对辣椒新品种保护的努力方向作出展望。China’s new agricultural variety protection system has been initially established,and relevant laws and regulations have been gradually improved.Pepper is the largest amount of application and authorization among the vegetable.In 2000—2018,380 applications for new varieties and 101 grants were applied,accounting for 16.4%and 14.9%of total vegetable applications and authorizations respectively.China’s pepper DUS test guide has been developed,and industry standards and operating manuals has been published.This paper briefly summarizes the current status and trends of new varieties of pepper breeding,and analyzes the status of protection of new varieties of peppers and DUS testing technical standards.Some questions and suggestions have been raised on the homogenization of the new varieties of peppers,the uniformity,the protection of variety rights,the description characters and operations of DUS test guides.At last,we make an outlook on the efforts of the protection of new varieties of pepper.
