“走婚同居”养老的法律问题研究

摘　　要：在我国,越来越多的老年人选择“走婚同居”养老。由于我国老年人同居立法缺失,导致老年人“走婚同居”面临诸多法律问题,例如,“同居养老”的合法性问题、日常家事代理权享有与否的问题、有无扶养权利与义务的问题、有无亲属权的问题、同居养老之共同财产的处理问题、同居养老者的继承权问题。我们亟需借鉴国外相关立法经验,创设老年人“走婚同居”养老合同制度,为老年“走婚同居”专门立法;为涉老案件提供法律援助;成立社区与村老年人服务组织。In China,more and more elderly people choose walking marriage and cohabitation for old age pension.Because of the lack of cohabitation legislation for the elderly in China,the elderly people are faced with many legal problems,such as the legality of“cohabitation for old age pension”,the right of daily family representation,the right and duty of maintenance,the problem of having no kinship,the treatment of common property of cohabitation and old age pension,and the inheritance rights.We urgently need to learn from foreign relevant legislative experience,create the walking marriage and cohabitation for old age pension contract system with special legislation,so as to provide legal assistance for the cases and establish community and service organizations for the old people.
