欧盟规制图书馆绝版作品数字化利用的版权立法实践与启示

摘　　要：欧洲图书馆在数字化进程中受到绝版作品版权问题的影响。为此,欧盟在最新的立法实践中采取延伸性版权集体管理制度予以规范,该项制度具有平衡利益关系的优势,既消除了图书馆取得授权的法律羁绊,又较好地维护了权利人的利益。我国图书馆数字化建设过程中面临的绝版作品版权问题应坚持从国情出发,学习借鉴欧盟立法,创新版权制度,对涉及的具体法律问题做出科学与全面的设计安排。European libraries encountered copyright problems of out-of-print works in the process of digitalization.For this reason,the European Union has adopted Extended Collective Licensing(ECL)in the latest legislation to regulate it.ECL has a comparative advantage of balancing the interest relationship.It not only eliminates the legal fetters of library authorization,but also better protects the interests of the right holders.To solve the copyright problem of out of print works in the process of digital construction of library in China,the author suggests that,basing on the national conditions,China should learn from EU legislation,innovate the copyright system,and make proper design and arrangements for the specific legal issues involved.
