摘　　要：法治秩序是与现实社会紧密结合的、动态的现时状态,法律规范的“合社会性”与社会运行的“合法律性”的有机结合,是法治秩序的理论“两翼”。法治秩序的生成,在于社会事实中“价值”被法律规范所吸纳,然后反作用于社会,进而达致法律规范的普适性与法律适用的统一性。当代中国法治秩序的生成面临着基层乡土性、法律悬浮化、“互联网+”时代等多重挑战,法律体系建成后,应当逐步由秩序建构向自发生成转型,大力培育社会组织并对民众进行公民精神塑造,通过秩序维系所需的“价值”内核的凝聚和融合,最终形成自治自主、多元互依的扁平化社会结构,进而生成契约化的基层法治秩序。Legal ordjsr is dynamic current status which is closely integrated with realistic society,the combination of legal norms close to society and social operation accord with law is the theory of“two wings”of legal order.The generation of the rule of law order is the“value”in the social fact absorbed by legal norms,then reaction to the society,to achieve the unity of the universality of the legal norms and legal application.The contemporary Chinese rule of law order generation faced with multiple challenges such as grassroots rural,legal suspension and“Internets-”era.After the completion of the legal system,it shall gradually transform from by the order of construction to the transformation of spontaneous generation,foster social organization and shape the people spirit of citizenship,condense and fuse“value”core which is required for maintaining order,eventually form the autonomous autonomy,flat structure of multiple interdependent society,thus generated leasing at the grass-roots level of the rule of law order.
