让与担保制度应纳入民法典物权编

摘　　要：让与担保是由学说、判例发展而来的非典型担保制度,凭借着应用场景广泛和节省交易成本的优势,迅速在担保领域占据了重要地位。近年来,随着我国社会和法治环境的日趋完善,让与担保制度的立法成文化具有了现实的基础。一是让与担保制度具备立法的必要性和可行性;二是让与担保制度的立法阻碍能够进行缓和;三是担保权构成模式下的让与担保制度契合现行物权法体系。在民法典编纂的时代背景下,应抓住历史机遇,将让与担保制度在我国实现立法成文化。Jean and guarantee is an atypical guarantee system developed by doctrine and jurisprudence,which,by virtue of the advantages of extensive application scenarios and saving transaction costs,has quickly occupied an important position in the field of guarantee.In recent years,with the improvement of China’s society and the rule of law environment,so that the legislation of the guarantee system into culture has a realistic basis.First,it is necessary and feasible to make legislation with the guarantee system,and the second is to allow the legislative obstruction of the guarantee system to be mitigated;third,the enabling and guarantee system under the constituent mode of the security right is compatible with the existing property law system.Under the background of the codification of the Civil Code,we should seize the opportunity of history and make the legislation become a culture in our country with the guarantee system.
