摘 要:在我国,对特别权力关系的研究可以实证法的相关沿革以及司法审查的实践为线索,尽管在相关立法以及司法审查实践中并不都是自觉地接受特别权力关系理论指导的。我国行政法学界对特别权力关系理论,除了"否定观""改良观"外,还存在"无视观"。随着行政法治的发展,特别权力关系理论在我国到底应该是怎样的历史命运,行政法学界已经不可回避。特别权力关系理论的发展与完善,除了立法的明确、解释的补充、判例的促进外,对裁量权的规制,特别是强化程序规制,则是现代行政法治理论与实践,促进传统特别权力关系转型升级的重要举措。新型特别权力关系理论实质上是对行政法律关系理论,从而也是对整个行政法学理论体系以及行政法治实践的发展和完善。In China,the research on the special power relationship can be based on the relevant evolution of empirical law and the practice of judicial review,although not all of the relevant legislation and judicial review practice are consciously guided by the theory of special power relationship. In addition to"negative view"and "improvement view",there is also"disregard view"in the theory of special power relationship in Chinese academic circles. With the development of the rule of law in administration,what kind of historical fate should the theory of special power relationship be in China? It is an unavoidable question in the field of administrative law. The development and perfection of the theory of special power relations,in addition to the clarity of legislation,the supplement of interpretation and the promotion of precedents,the regulation of discretion,especially the strengthening of procedural regulation,is an important measure to promote the transformation of traditional special power relations by modern administrative rule of law. The new theory of special power relationship is essentially the theory of administrative legal relationship,which is also the development and perfection of the whole theoretical system of administrative law and the practice of administrative rule of law.
