摘 要:《联合国反腐败公约》明确提出构建防止利益冲突制度预防腐败。中国共产党自2000年以来,特别是十八大后,也明确把防止利益冲突作为科学有效地预防腐败的深化改革方式。在反腐败刑事政策语境中,必须从影响反腐败治理的基础性、长远性、根本性和全局性方面创新治理机制。在反腐败协同治理刑事政策下,应突破预防、教育、公众参与和国际合作等制度之间的壁垒,充分释放有效治理要素的潜能。因此应当在全面依法治国的战略下建立健全反腐败协同治理法律规范体系,其中反腐败刑事政策预防侧改革的主要表现就是利益冲突机制的构建与完善。The United Nations Convention against Corruption explicitly proposes the establishment of a system to prevent conflicts of interest to prevent corruption.Since 2000,the Communist Party of China has recognized the prevention of conflicts of interest as an effective method for the prevention of corruption.In the context of anti-corruption criminal policy,we must innovate the governance mechanism from the basic,long-term,fundamental and global aspects.With the help of anti-corruption criminal policy of collaborative governance,we should break through the system barriers between prevention,education,public participation and international cooperation,realizing the potential of governance measures.We should establish and improve the legal system of anti-corruption criminal policy of collaborative governance within the comprehensive framework for promoting the rule of law.For anti-corruption criminal policy,collaborative governance is mainly reflected in the establishment and perfection of the mechanism for the prevention of conflict of interests.
