摘 要:当前,无论是在环境民事公益诉讼中还是在环境行政公益诉讼中,公民都不具有诉讼主体资格。这种状况无益于环境公益诉讼的正常演进和健康发展。确立公民在环境公益诉讼中的主体地位既有必要性,也有可行性。制度构建要明确公民的诉讼主体地位,遵循先环境行政公益诉讼后环境民事公益诉讼的顺序安排,借助对公民的制度激励,提升行政机关的作为积极性,使环境公益诉讼良性发展。At present,no matter in environmental civil public interest litigation or environmental administrative public interest litigation,citizens do not have the qualification of litigation subject.This situation is not conducive to the normal evolution and healthy development of environmental public interest litigation.In fact,it is both necessary and feasible to establish citizen’s principal position in environmental public interest litigation.We should clarify the status of citizens as the main body of litigation,arrange the sequence of environmental administrative public interest litigation before environmental civil public interest litigation,and promote the enthusiasm of administrative organs by means of institutional incentives to citizens,so as to make environmental public interest litigation develop benignly.
