红色历史文化遗产保护地方立法评析与前瞻

摘　　要：红色文化传承创新的法治化以科学、有效的立法调整为前提,属于设区的市立法权限中“历史文化保护”的重要事权项目。厘清对红色文化遗产进行地方立法保护的理论基础,评价红色文化地方立法保护在核心价值观入宪与社会主义文化建设上具体承载与有机融合的规范设计,是地方立法发展深化的理论助益。其中,《龙岩市红色文化遗存保护条例》和《吴忠市红色文化遗址保护条例》有一定的先进性和代表性,也存在公众参与缺失、政府保障不足等局限。需明确,红色历史文化遗产保护立法在本质上是国家文化主权的自我宣示和制度实现,在功能上是国家文化治理政策法律环境的制度渊源。为此,需进一步规定主体单位负有展示、展现红色文化中的精神成分的义务和职责,充分体现红色历史文化遗产空间的人民属性,注重红色历史文化遗产保护、开发、利用与《文化产业促进法》有关规定之间的衔接。在红色历史文化遗产保护的法律制度精准化、精细化、协同化的规范设计上,凸显其特殊性、针对性和实效性。The legalization of inheritance and innovation of red culture should follow the principle of scientific and effective legislative adjustment.It also belongs to the important item of districted cities legislative authority in the project of“historical and cultural protection”.It is helpful to deepen the development of local legislation by clarifying the theoretical basis of the local legislative protection of red cultural heritages,and evaluating the normative design of the specific bearing and organic integration of the core values into the Constitution and the socialist cultural construction of the local legislative protection of red culture.In this context,the Longyan Regulations and the Wuzhong Regulations are advanced and representative regulations to some extent.But there are still some outstanding limitations of them,such as a lack of public participation and the inadequate governmental guarantee.It should be made clear that,the legislation for the protection of red historical and cultural heritage is essentially a self-declaration process as well as a systematic realization of the national cultural sovereignty and legal environment for national policy of cultural governance.Thus,it is necessary to further stipulate that the responsible institutions have the obligation and responsibility to display the spiritual components of red culture,fully reflect the people s attributes of red historical and cultural heritage space,and focus on the cohesion between the protection,development and utilization of red historical and cultural heritage and the relevant provisions of the Law on the Promotion of Cultural Industry.In terms of accurate,refined and collaborative design of legal system of red historical and cultural heritage protection,it should focus on its uniqueness,target and effectiveness.
