高校学生心理危机事件法律风险浅析

摘　　要：大学生心理危机事件是影响高校安全稳定的重要因素,在依法治校背景下,正确理解高校学生心理危机事件的定义和特征,并对存在的法律风险明确分类,有助于危机事件处理过程中防范法律风险,具有重要现实意义。作者从高校学生心理危机事件的定义入手,将特征划分为形成原因多样性与事件结果敏感性两部分。对该过程中存在的法律风险明确分为民事法律风险、行政法律风险和程序性法律风险,具体表现在预防和应对阶段是否尽到高校安全责任中的注意义务,发现后是否尽到教育引导义务,过程中是否存在侵犯隐私权等侵权行为;事件发生时,高校是否及时采取积极的应对措施,应急处置过程中是否注意公民合法权益的保障;善后阶段是否尽到了疏导等法定善后义务,是否为学生提供合理合法的申诉渠道等。The psychological crisis of university students is an important factor affecting the security and stability of colleges and universities. Under the background of school governance, the definition and characteristics of college students’ psychological crisis events are correctly understood, and the existing legal risks are clearly classified, which helps to prevent the crisis incidents. Legal risks have important practical significance. The author starts with the definition of college students’ psychological crisis events, and divides the characteristics into two parts: the cause diversity and the event result sensitivity. The legal risks existing in the process are clearly divided into civil legal risks, administrative legal risks and procedural legal risks, which are specifically manifested in the duty of care in the prevention and response stage to the safety responsibility of colleges and universities. In the process, if there is any infringement of privacy violations in the process, when the incident occurs, does the university take timely and positive measures, and pay attention to the protection of the legitimate rights and interests of the citizens during the emergency response process? Is the statutory after-care obligation such as diversion and guidance in the aftermath phase? Provide students with reasonable and legitimate complaint channels.
