浅析房屋征收中的司法强制执行

摘　　要：《国有土地上房屋征收与补偿条例》取消行政强拆后,有效避免了行政机关在房屋征收与补偿工作中“既当裁判员、又当运动员”的局面。但是在当前司法机关对司法强制执行案件的受理采取较为谨慎态度的前提下,推动实现司法强制执行在实践中仍有许多亟待解决的问题。本文旨在研究探讨如何进一步完善房屋征收与补偿中的司法强制执行制度,维护被征收人的合法权益,提升政府与法院的权威性和公信力,从而推动房屋征收与补偿工作依法、和谐开展。After the abolition of the administrative demolition of the regulations on“Housing Expropriation and Compensation Regulations on State Owned Land”,the situation of“be both a referee and an athlete”in the house expropriation and compensation work was effectively avoided.However,under the premise that the current judicial organs take a more cautious attitude towards the acceptance of judicial enforcement cases,there are still many problems to be solved in the practice of promoting judicial enforcement.The purpose of this paper is to study how to further improve the judicial enforcement system in house expropriation and compensation,safeguard the legitimate rights and interests of the expropriated person,and enhance the authority and credibility of the government and the court,so as to promote the work of housing expropriation and compensation to be carried out in accordance with the law and harmony.
