摘 要:权利限制不仅需要相应的合法性前提,更需要从民意范围上考虑权利限制决策的可接受度。要构建新型的协商民主与权利限制的关系,就必须对协商民主进行有效的制度立论分析,同时对协商民主中的治理逻辑进行分析。信息公开与充分参与、多层面协商与程序保障、反馈真实与案卷排他,都是协商民主中可以施行的具体机制。对于权利限制的决策,可经由协商民主进行针对性的剖析,依决策的性质而决定协商的过程与深度,通过协商来实现权利限制决策的科学性,实现“以人民为中心”的公共决策宗旨。The restriction of rights requires legitimacy premise;at the same time,it also needs to consider the acceptability of the decision regarding the restriction of rights within the scope of public opinion.In order to construct a new relationship between consultative democracy and restriction of rights,it is necessary to make an effective analysis of the institutional ground of consultative democracy and its governance logic.Consultative democracy can be realized in the following mechanisms,such as information disclosure and full participation,multi-level consultation and procedural guarantee,feedback authenticity and file exclusion.The decision-making regarding the restriction of rights is investigated via consultative democracy.The process and extent of consultation can be determined according to the nature of the decision.As a result,the scientific decision regarding the restriction of rights can be realized through consultation,with the people-centered principle in mind.
