摘  要:游戏直播活动中以用户为主体的直播行为方式及以电子游戏画面为基础的新兴商业模式,不但使直播主体身份的多样性对判断其二次使用是否构成著作权侵权例外带来了困难,而且导致游戏画面著作权人与其二次使用者在游戏直播活动中的贡献多寡难以判断。虽然已有判决默认所有直播主体的直播行为均属侵权,要求游戏直播平台全数赔付相关利润,但是为了平衡个人权利与公共利益,并防止著作权人从侵权损害赔偿中不当得利,应该对签约主播与非签约主播作出区分,仅就不构成合理使用的签约主播行为要求游戏直播平台承担连带责任,同时明晰游戏直播视频上存在的增值利益,严格依照权利人损失计算侵权损害赔偿数额。As video game live-streaming activities rely mainly on users'conducts and base the business model on video game motion picture,this situation brings difficulty on judging whether users'secondary use constitutes an exception to copyright infringement as users'identities divert and makes it difficult to determine the respective contribution to live-streaming activities of video game motion pictures'copyright owner and of their secondary users.Although it has been decided implicitly that all conduct of live-streaming from any user is infringing and full compensation with all relevant profit of the live-streaming platform is required,in order to balance individual's rights with the public interest and to prevent copyright owner from unjustly benefiting from damages,we shall differentiate contracted anchors from uncontracted anchors,so that live-streaming platforms only assume joint responsibility for conducts of contracted anchors,as their conducts are not eligible for fair use.Moreover,we shall clarify the value-added benefits generated by live-streaming videos and calculate the amount of damages strictly according to the loss of right holder.
