摘　　要：我国现行行政规章尚未明确规定流动人员人事档案的所有权归属,直接或间接导致实践工作中出现“弃档”“死档”“自留档案”“单位扣留档案”等诸多问题。本文论证了流动人员人事档案国家所有权的法律基础、政策导向和现实意义。首先,立足学界流动人员人事档案所有权的现有认识,从法律层面阐述流动人员人事档案所有权的各项权能,论证了流动人员人事档案国家所有的法律基础。其次,提出流动人员人事档案国家所有权的政策导向。最后,从流动人员本人、档案形成单位、档案保管机构和国家四方面阐述了国家所有权的现实意义。China’s current laws and policies have not clearly stipulated the ownership of personnel archives of floating people,which directly or indirectly leads to many problems in practice,such as"abandoning archives ","dead archives","keeping archives by oneself "and"keeping archives by units".This paper demonstrates the legal basis,policy basis and practical significance of the state ownership of personnel archives of floating people.Firstly,on the basis of the existing understandings of the ownership of personnel archives of floating people,this paper expounds the powers and functions of the ownership of personnel archives of floating people,and demonstrates the jurisprudence basis that personnel archives of floating people belong to the state.Secondly,this paper puts forward the policy basis of the state ownership of personnel archives of floating people.Finally,the practical significance of state ownership is elaborated from four aspects:floating people themselves,archives forming units,archives custody institutions and the state.
