论正当防卫制度司法适用的纠偏

摘　　要：维稳观念的不当贯彻,导致正当防卫的成立空间在司法实务中被大大地压缩,正当防卫的规定由此沦为"沉睡的规定"或"僵尸条款"。因此,对正当防卫制度的司法适用亟待进行纠偏。但是,对正当防卫制度司法适用的纠偏应当是以保证《刑法》中正当防卫的规定得到正确适用为前提的。从目前的情况来看,在实务和理论两个层面均存在着对正当防卫制度司法适用的"过正"纠偏现象:从实务的层面来看,存在着将正当防卫与事后防卫进行混同的问题;从理论的层面来看,则存在着将防卫过当与正当防卫进行混同的问题。这不适当地扩大了正当防卫制度的司法适用空间。为此,对正当防卫制度的司法适用有必要进行再度纠偏。The improper implementation of the concept of maintaining stability has resulted in the fact that the establishment space of justifiable defense is greatly compressed in the judicial practice.Thus the provisions of justifiable defense are reduced to"sleeping provisions"or"zombie clauses".Therefore,the judicial application of the system of justifiable defense needs to be rectified urgently.However,to rectify the judicial application of the system of justifiable defense should be based on ensuring the correct application of the provisions of justifiable defense in the criminal Law.Judged from the current situation,as far as the judicial application of the system of justifiable defense is concerned,excessive rectifications exist:in the practical level,the justifiable defense is confused with the afterwards defense;in the theoretical level,justifiable defense is confused with excessive defense.Thus the judicial applicable space of the system of justifiable defense is expanded inappropriately.In view of these phenomena,it is necessary to rectify the judicial application of the system of justifiable defense again.
