规范刑法学视野下非法狩猎罪司法解释的基本逻辑

摘　　要：近些年来,我国加大了运用刑事手段保护"三有动物"的力度。但是,审判机关对非法狩猎罪的系列判决引发了公众的争执。究其缘由主要在于最高人民法院对于非法狩猎罪的司法解释存在定罪标准太低,背离立法原意越权解释,循环解释以及对主观违法性要素"明知"解释欠缺等。非法狩猎罪司法解释在刑法规范框架内科学、合理地完善,以实现立法的实质正义。具体来说,应当删除现行解释第6条中第2项和第3项,适当提高定罪数量标准,将狩猎数量与破坏野生动物资源结合起来确定定罪的基本标准。当非法狩猎行为没有达到规定数量时,应当增加使用禁用的工具和方法10次以上以及非法狩猎行为被行政处罚过两次以上应当定罪的标准,将"明知"证明要求在解释中予以规定。In recent years,China has strengthened criminal means to protect"the three animals",i,e.species listed to be valuable in ecology,society,and scientific research.But a series of court decisions on the crime of illegal hunting triggered public controversy.The major reason is that the judicial interpretation of illegal hunting crime by the Supreme People’s Court shows a low standard of conviction,ultra vires interpretation deviated from original legislative intention,circular interpretation,the lack of interpretation of subjective illegal element"knowing clearly",and other problems.The judicial interpretation of the crime of illegal hunting should be scientifically and reasonably improved within the framework of criminal law so as to realize the substantive justice of legislation.In particular,the current interpretation of articles 6(2)and(3)should be deleted,the number of convictions should be appropriately raised,and the basic criteria for determining a conviction should be combined with the number of hunts and the destruction of wildlife resources.When the illegal hunting behavior does not reach the specified amount,the standards of using prohibited tools and methods for more than 10 times and the illegal hunting behavior has been punished twice or more shall be increased as standards of crime,and the"knowingly"proof requirements shall be stipulated in the interpretation.
