标准视域下《公共图书馆法》实施:障碍、模式与路径

摘　　要：研究法律对标准的融合吸收是贯彻公共图书馆法实施,推动图书馆事业高质量发展,实现二者共同治理图书馆事业法制化的重要举措与有效路径。文章在分析影响公共图书馆法实施障碍因素的基础上,通过图书馆法律与标准规范融合的共性基础、内在动因、外因、现实需求等机理的分析,探讨了公共图书馆法吸收融合标准的模式与路径,包括通用条款模式、参照模式、法律必要标准等显性路径模式,法律实施细则与标准融合的并入、参照等隐性路径模式。The research on law-standard conjunction is an important measure and effective way to enhance law enforcement,promote the high-quality development of library cause,and make sure the realization of common governance of library.On the basis,the paper analyzes the impeding factors in the implementation of public library law,discusses the modes and paths for the conjunction of library laws and standards from the common fundamental problem,inner motivation,external cause,and real need.The main modes include the explicit paths such as general terms,reference,setting standards,and the implicit ones such as the conjunction of law enforcement regulations and standards.
