摘　　要：智能社会将人类生活带入高度解析解构的双重进程:一方面是个体生命和生活被大数据高度解析,另一方面是现有制度面临解构。在智慧养老模式中,传统之家变为智能之家,伦理之人变为技术之人,传统家庭的父慈子孝变成了现代家庭的人机交互。技术解构了传统意义上的家、家庭成员及家庭养老模式,对现有法律制度中的家庭、人、养老等概念及制度安排提出了新的挑战。应从规范、道德及事实维度对立法进行法理反思,坚守人类中心主义立场,激活传统家文化的有益价值,探究人文与技术的黄金分割点,融贯处理法律与其他社会规范的关系。The intelligent society brings human life into a dual process of highly analytical deconstruction:on the one hand,it is big data’s highly analysis of individual being and life,on the other hand,it is the deconstruction faced by existing system.In the framework of intelligent pension,a home of tradition has been transformed to a home of intelligence,people talking about ethics have changed to people mastering techniques,and the traditional father-son family scene has evolved to the modern people-machine family scene.Technique deconstructs the tradition structure of a family,family members and family care-for-the-elderly,imposing new challenges on the concept of family,people,and care of the elderly and other systemic arrangements in the current legal system.Jurisprudence should be reflected from multiple angles such as the norms,ethics and facts etc.,anthropocentrism is the stance we should adhere to,values of the traditional culture of family should be activated,the golden division of humanities and technology should be explored,and the relationship between law and other social norms should be dealt with.
