社会老龄化背景下老年人监护、辅助制度的思考

摘　　要：老龄化社会的到来对我国《民法通则》中的监护制度提出了新挑战。《民法总则》适应时代要求,对于监护制度作了若干重要修正与补充,包括无民事行为能力或者限制民事行为能力的成年人的范围不再仅局限于"精神病人"、增补意定监护制度、临时监护制度、监护人资格撤销制度等,但其规定也存在着诸多不足。基于《民法总则》关于监护制度的框架性规定,在编纂民法典婚姻家庭编时,为适应老龄化社会加强老年人权益保障的需要,应进一步完善老年人监护制度,包括改变监护的单一模式,完善成年监护、成年辅助制度的"二元"模式,扩大受保护的被监护主体范围,完善现有的意定监护、监护监督制度等。The aging society poses new challenges to guardianship system in General Rules of the Civil Law of PRC.The General Provisions of Civil Law adapts to the requirements of the times and makes some important amendments and supplements to the guardianship system.The scope of adults with civil disability or limited capacity for civil conduct is no longer limited to "people with mental illness",supplementary adult guardianship system,temporary guardianship system,or the guardianship revocation system,etc.,but there are also many deficiencies in its regulations.Based on the framework provisions of the existing guardianship system of the General Provisions of Civil Law,in the compilation of marriage and family volume of the Civil Code,it is necessary to adapt to the need of strengthening the protection of the rights and interests of the elderly in an aging society,further improve the elderly guardianship system,including changing the single pattern of the guardianship system and improving the "dual subject" pattern of adult guardianship and adult support system,expand the scope of protected subject of guardianship,and improve the existing system of intentional custody,adult guardianship system,and guardianship and supervision system.
