摘　　要：自从奥运会开启了“体育+商业”的运作模式,便出现了奥林匹克知识产权的侵权与保护问题。奥林匹克知识产权是现代奥运会商业化运作的重要组成部分。运用文献研究法、逻辑分析法等,结合国内实际和国际惯例,对“奥林匹克知识产权”的内涵、奥林匹克知识产权保护的价值、北京2022年冬奥会知识产权权利构成要素、侵权行为识别、北京2022年冬奥会知识产权保护的阶段划分、我国奥林匹克知识产权保护机制基础进行分析论述。认为北京2022年冬奥会知识产权保护包括权利取得、权利行使、权利救济3个阶段,但是在北京2022年冬奥会知识产权侵权纠纷解决机制和隐性市场侵权行为等方面需进行机制设计。基于此,提出北京2022年冬奥会知识产权保护措施,以期为北京2022年冬奥会知识产权保护筑牢机制基础和完善法律保障提供理论参考。Since the Olympic Games contains the operation mode of“sports+commerce”,the infringement and protection of Olympic intellectual property rights have appeared,and the Olympic intellectual property rights are an important part of the operation of modern Olympic Games.Combining domestic practice and international practice,using literature research and logic analysis method to analyze the connotation of“Olympic intellectual property rights”,the value of Olympic intellectual property protection,the elements of intellectual property rights of Beijing 2022 Winter Olympics,identification of infringement,Beijing 2022 The Stage Division of intellectual property protection in the Winter Olympic Games and the mechanism basis of Olympic Intellectual property protection in China.It is believed that the intellectual property protection of Beijing 2022 Winter Olympics includes three stages:acquisition of rights,exercise of rights,and relief of rights.However,it is necessary to design the mechanism in the 2022 Winter Olympics intellectual property infringement dispute resolution mechanism and hidden market infringement.Based on this,the intellectual property protection measures of the Beijing 2022 Winter Olympics were proposed.It is intended to provide a theoretical reference for the Beijing 2022 Winter Olympics intellectual property protection mechanism and the perfection of legal guarantee.
