摘　　要：世界贸易组织的成立促进了全球贸易融合发展,降低了各国的原有关税,其体系下的TRIPs协定更是以法律形式规范了国际贸易中有关知识产权的保护。然而,近年来再次兴起的单边主义和保护主义对WTO的权威性和有效性构成了严峻的挑战,从2018年3月开始的中美贸易战更是把知识产权保护问题提到了WTO规则改革的新高度。文章梳理了TRIPs协定实施以来,在推动国际知识产权保护水平提高、刺激知识密集型产品出口以及促进世界各国自主创新能力提升中所取得的成绩,分析了TRIPs协定存在的问题,如TRTPs协定的滥用、争端解决机制运行效率低下、发展中国家利益保护不足以及TRIPs协定参与主体的不平衡,最后针对这些问题提出相应的政策建议。The establishment of the World Trade Organization has promoted the development of Global trade in tegration and reduced the original relevant taxes among countries.The TRIPs agreement under its system regulates the protection of intellectual property rights in international trade in the form of law.However,the rise of unilateral ism and protectionism in recent years poses a serious challenge to the authority and effectiveness of WTO.The Sino-US trade war,which began in March 2018,has pushed the issue of intellectual property protection to a new level in the reform of WTO rules.Therefore,the article will focus on the TRIPs agreement.Firstly,it will review the achieve ments of TRIPs in promoting the level of international intellectual property rights,stimulating the export of knowl edge-intensive products and promoting the ability of independent innovation of countries in the world since the im plementation of TRIPs agreement.At the same time,the existing problems of TRIPs agreement will be analyzed,such as abuse of TRTPs agreement,inefficient operation of dispute settlement mechanism,insufficient protection of interests of developing countries and imbalance of the main force involved in the formulation of TRIPs agreement.Fi nally,the corresponding policy suggestions are put forward for these problems.In a word,although these problems seem complicated,the key step to solve them lies in communication and cooperation among developing countries.Meanwhile,China should play a key leading role in the current situation,and actively promote the construction of the community of human destiny.That is the top priority.
