粤港澳大湾区民商事司法协助的现状与未来发展  

Practice and Future Development of Civil and Commercial Judicial Assistance in Guangdong-Hong Kong-Macao Greater Bay Area

摘　　要：港澳回归以来,以内地法域为整体与港澳之间签订的多项民商事司法协助安排构成粤港澳大湾区民商事司法协助的制度基础。但是内港澳民商事司法协助存在制度实施进程缓慢、民商事司法协助范围局限、民商事司法协助方式相对保守以及民商事司法协助制度构建碎片化的问题,影响了区际民商事司法协助制度的运作效果,也与粤港澳大湾区一体化发展的需求不相适应。根据《香港基本法》第95条和《澳门基本法》第93条,区际民商事司法协助可以由多元主体采用多种模式在多个领域推进司法联系与相互协助,为粤港澳大湾区加强民商事司法协助提供了法律依据。未来粤港澳大湾区可以探索推进民商事司法协助模式的多样化,完善和拓展民商事司法协助内容,创新民商事司法协助方式并打造大湾区民商事司法协助中心,以推进民商事司法协助的高效化、常态化和制度化发展。Since the return of Hong Kong and Macao,the mainland,as a role of an independent and complete jurisdiction,has signed plenty of arrangements for civil and commercial judicial assistance with Hong Kong and Macao,which has formed the fundamental institution of the civil and commercial judicial assistance in Guangdong-Hong Kong-Macao Greater Bay Area.However,at present,there are many problems in the civil and commercial judicial assistance system,for instance,the implementation process of the system is slow,the scope of civil and commercial judicial assistance is limited,the method of civil and commercial judicial assistance is relatively conservative and the construction of the system is totally fragmented.These problems a ffect the operation result of civil and commercial judicial assistance system and make it hard to meet the need of integration and development in Guangdong-Hong Kong-Macao Greater Bay Area.Since Article 95 of the basic Law of Hong Kong and Article 93 of the basic Law of Macao provide the legal basis to strengthen the judicial contact and mutual assistance in Guangdong-Hong Kong-Macao Greater Bay Area,the regional judicial assistance in civil and commercial matters can be promoted by multiple institutions in many fields.In the future,Guangdong-Hong Kong-Macao Greater Bay Area should explore a variety of modes of judicial assistance,constantly expand the content of judicial assistance,innovate the method of judicial assistance and build a civil and commercial judicial assistance center in this area.In conclusion,through these measures to promote e fficient,normalizing and institutionalized development of civil and commercial judicial assistance system.
