摘　　要：澳门土生葡人国籍问题因中国和葡萄牙两国国籍法在不同时空条件下在澳门的适用而产生。中葡两国政府基于不同立场曾就相关问题展开正式磋商,最终以中国全国人大常委会关于中国国籍法在澳门实施的法律解释所确立的允许土生葡人选择国籍的办法加以处理。回顾这一问题的解决过程并就相关法理逻辑进行分析,具有重要的理论和实践意义。The nationality issue of the so-called“Macanese”was originated from the dual application of the Chinese and Portuguese nationality laws in different periods and circumstances.The two governments negotiated based on their different standpoints,and finally it is decided to allow settled by the Macanese to choose their own nationality,a right granted by the interpretation given by the Standing Committee of National People’s Congress of the application of the Chinese nationality law in Macao.It is of great theoretical and practical significance to review how the dispute was resolved and analyze the legal logic behind it.
