摘　　要：公证是对民事法律行为、具有法律意义的事实和文书的真实性、合法性进行证明的活动。公证能促进技术秘密的创造、运用与保护,提升企业创新研发能力,降低技术秘密保护的法律程序成本,提升司法保护效率,营造良好的营商环境,服务经济高质量发展。目前公证介入技术秘密保护的基本模式,分为两类:确权公证模式与维权公证模式。其中确权公证,包括权属主体公证、技术秘密的内容公证以及保密措施公证,从而给予研发技术保护的可期待性,激励研发人员大胆创新与运用;维权公证,包括侵权主体公证、侵权行为公证以及侵权地点公证,破除技术秘密侵权举证难困境,降低企业法律保护程序的成本。Notarization is an activity to prove the authenticity and legitimacy of civil legal acts, facts and documents with legal significance. Notarization can promote the creation, application and protection of technological secrets, enhance enterprises’ innovative R&D capabilities, reduce the cost of legal procedures for the protection of technological secrets, improve the efficiency of judicial protection, create a good business environment and serve the high-quality development of the economy. At present, the basic modes of notarization intervention in the protection of technological secrets are divided into two categories: the confirmation notarization mode and the maintenance notarization mode. Among them, power-confirming notarization includes ownership notarization, content notarization of technological secrets and the notarization of confidentiality measures, which can provide the expectancy of technological protection for R&D and encourage R&D personnel to boldly innovate and use;rights-defending notarization, including the notarization of infringement subject, infringement act and infringement place, breaks the difficult situation of proof of infringement of technological secrets, and reduces the cost of legal protection process of enterprises.
