摘　　要：农村派出所参与交通安全管理正成为各地建设美丽平安乡村的重要举措。从传统观点看,道路交通安全法仅仅明确授权公安机关交通管理部门负责全国城乡的道路交通安全管理工作,派出所参与交通安全管理似乎缺少相应的法律依据,由此必然会带来相应的法律风险。为配合全国农村道路交通安全管理体制改革,提出需要从地方性法规、部门规章或政府规范性文件层次创设相应条文,以适应派出所参与农村交通安全管理的改革大趋势。The rural police stations participate in traffic safety management is becoming an important measure for building beautiful and peaceful villages everywhere.From a traditional point of view,the Road Traffic Safety Law only explicitly authorizes the public security organ traffic administrative department to be responsible for the traffic safety management in urban and rural areas,the police stations participating in management seems to lack the corresponding legal basis and bring legal risks.In order to cope with the reform of the national rural road traffic safety management system,it is proposed to create corresponding provisions from the local regulations,departmental regulations or government normative documents to adapt to the reform trend of the police station to participate in the management.
