摘  要:基于未成年人刑事司法中的国家亲权、儿童福利理念,未成年人社会调查制度的理念应当是保护优先,即在未成年人保护和社会保护两种价值目标的权衡中,坚持保护优先。在未成年人刑事审判中,未成年人社会调查制度的功能定位是为刑事审判中对涉罪未成年人的“因人施教”、非犯罪、非刑罚、非监禁处遇以及判后教育、矫正、改造提供依据。在明晰未成年人社会调查制度的理念和功能定位的基础上,从实然层面考察,我国的社会调查制度在调查主体设置、适用范围和内容等方面存在诸多问题,从应然层面看,我国未成年人社会调查制度的理想图景应该是在未成年人刑事司法机制不断完善的基础上实现未成年人社会调查制度的体系性优化。Based on parents patriae and the idea of child welfare in juvenile criminal justice,the concept of the juvenile social inquiry system should prioritize protection,i.e.when weighing the value objectives of juvenile protection and social protection,it should insist on protection priorities.In the juvenile criminal justice system,the functional orientation of the juvenile social inquiry system was to provide a basis for“individualized teaching”of crime-involved juvenile in criminal justice,their non-crime,non-penalty and non-custodial treatment as well as education,correction and modification after the sentence.After clarifying the concept and functional orientation of the juvenile social inquiry system,from the Actual(what it is)perspective,the social inquiry system has many problems in the scope and content of the subject setting,etc.;on the other hand,from the Ideal(what ought to be)perspective,the prospect of the juvenile social inquiry system should realize the systematic optimization of itself based on further improvement of the juvenile criminal justice mechanism in China.
