摘 要:土地经营权之物权化,需基于权利设立的不同方式,对土地经营权予以类型化划分,并根据其权利设立方式的不同,明确其法律的性质,进而构建土地经营权物权规则。以承包经营权为成员权自物权,以经营权为用益物权,更加契合我国物权实践和理论。对此,应围绕土地经营权得丧的权利变化,在权利设立方式、权利期限、登记规则、流转规则、担保物权设置和实现等方面,按照物权的基本原理构建土地经营权。The property rights on land management should base on different modes of rights setting,categorize the land management rights,abide by its rights setting modes,define the legal nature,and construct land management property provisions. To fit for China property practice and theory,the contracted property rights should be defined as self-property rights attached to the colour of member rights,as well as usufruct rights. Therefore,we should focus on the changing procedures of land management rights’ gain and loss,examine the aspects of rights setting modes,rights time limits,registration rules,circulation rules,setting and realization of property rights on pledge,follow the principles of property rights,and construct the relatively comprehensive land management rights with property as main nature reference.
