摘 要:环境安全日益受到公众关注并使得我国环境监管模式逐步从管制治理型向法治预防型转变,公众参与方式也逐步从事后救济向事前预防转变。工业化社会的形成使得"公众"群体结构日益复杂,但在传统行政主导下,现行环境立法并没有对公众作为参与监督主体进行类型化设计,公众在参与环境安全监督过程中面临监督角色边缘化、监督行为和监督效力附从化的窘境。完善我国环境安全公众参与监督的法律机制,应构建利益层次分明的公众参与法律体系,建立多元化的公众监督排污企业的法定渠道,拓展公众监督行政监管的途径。The public is paying increasing attention to the environment safety, which makes environmental supervision mode gradually changed from regulation governance to legal prevention, and the public participation mode has changed from afterwards relief to pre-prevention. The industrial society makes the structure of public groups more complex, but the current environmental legislation fails to carry out a type for the public to play a major roled in participating supervision under the leadership of traditional administration, and the public is faced with difficulties of marginalized supervision role, reliant and ineffective supervision. To improve the legal mechanism on public participation in environmental safety supervision, we should construct a public participating legal system to protect distinct level of interests, establish legal channels of public supervision on polluters, and expand way of public supervision on administration.
