摘　　要：数据流通共享是促进数据红利释放的基石,数据利用和个人信息保护的良性互动方能有效实现数字经济高质量发展。本文以个人信息保护与共享为研究对象,构建信息主体与数据业者两方非合作演化博弈模型,探讨参与主体的行为演化特征及其稳定策略,借助MATLAB数字仿真技术,模拟分析不同情形下参与主体演化稳定策略,对信息主体授权共享、数据业者利用的理想化"合作"博弈提出制度上的解决方案。研究表明,影响信息主体和数据业者选择策略关键在成本收益预期,实现两者在数据共享和信息保护的最优解可以通过政府行政管制、数据业者内部治理机制、司法责任制度等数据政策工具。组合运用政策工具能促使数据业者将个人数据信息安全保障纳入企业生产函数,激励信息主体积极共享、数据业者积极利用个人数据信息的演化稳定策略。因此,为实现数据保护与共享理想演化均衡的双重帕累托改进,应加强政府公权监管、培育数据业者内部治理机制、完善司法责任制度。The data sharing is the base of the release of data profits.The benign interaction between data utilization and personal information protection can effectively realize the high-quality development of digital economy.This article focuses on personal information protection and sharing with a non-cooperative and evolutionary game between the information subject and data operator,to imitate evolutionary stable strategies under different situation to find the institutional solution of the idealized"cooperation"game.It shows that the key which influences the selection strategy is the cost-benefit expectation.It is the best way to make data sharing and information protection harmoniously through government,internal governance,judicial liability and other data policy tools.Policy set could encourage data companies to integrate security into production function,and encourage the active sharing of information subject.Therefore,to achieve dual pareto improvements of data protection and sharing,it is necessary to strengthen the government’s public power,to cultivate the internal governance of data industry,and to improve the judicial responsibility.
