摘　　要：网络视听的发展在带给视听众不受时间、空间限制地收看视听节目便利的同时,也给内容规制提出了挑战。在梳理我国网络视听的发展与规制、总结欧美网络视听内容规制经验的基础上,进行研究设计,选择OTT TV作为研究案例。基于OTT TV的思考包括牌照制度的合意性、规制范式转换及“平台—政府”规制范式,思考发现:牌照制度的合意性日趋薄弱,应先突破平台与内容捆绑规制模式,再针对视听内容考虑更合适的规制模式,“平台—政府”双元规制范式成为较优选择,向市场主导、“管办分离”及更加注重平台自我规制是双元规制实现的重要命题与必要条件。The development of network audiovisual brings convenience for audiovisual audience to watch audiovisual programs without time and space restrictions,but also challenges the content regulation.On the basis of combing the development and regulation of network audiovisual content in China and summing up the experience of regulation of network audiovisual content in Europe and America,this paper carries out research and design,and chooses OTT TV as a case study.The consideration based on OTT TV includes the conformity of licence system,the transformation of regulatory paradigm and the“platform-government”regulatory paradigm,which finds that the conformity of licence system is becoming weaker and weaker,we should first break through the platform-content binding regulatory model,and then consider a more appropriate regulatory model for audio-visual content,the“platformgovernment”dual regulatory paradigm becomes a better choice,leading to the market and“management”,separation of operation and more emphasis on platform self-regulation are important propositions and necessary conditions for the realization of dual regulation.
