摘 要:报复性解雇与一般违法解雇的特性差异显著,传统劳动法上的违法解雇救济程序不能有效地处理报复性解雇争议。针对报复性解雇,需要设计出一套特殊的救济程序性规则。对于个别劳动关系领域中报复性解雇争议,须采用司法救济程序,并排除协商、调解、仲裁程序的适用;对于集体劳动关系领域中报复性解雇争议,应当采用行政救济程序。可通过立法来优化现有违法解雇救济程序的功能,并将报复性解雇救济程序性规则有机地嵌入其中,以完善我国的解雇保护制度。Owing to the huge differences between retaliatory discharge and illegal discharge,the traditional illegal dismissal procedures could effectively not handle the dispute of retaliatory dismissal in time.Therefore,it is essential to set up special procedural rules for dealing with retaliatory discharge.For one thing,it’s necessary to apply judicial relief procedures to settle the dispute of retaliatory in the area of individual labor relationship.For another,it is vital to apply administrative relief procedures to defuse the dispute of retaliatory in the field of collective labor relationship.Then we should improve the functions of current relief procedures of illegal dismissal by the way of legislation.And we must put the procedural rules of handling retaliatory discharge into those procedures for promoting the systems of dismissal protection.
