摘　　要：山西省虽然通过科学设置排污权交易市场、开展跨区交易、调节基准价、降低交易手续费、简化交易申报等措施活跃排污权交易市场,但效果并不太明显,依然存在行政行为明显、企业自主参与不足、交易价格形成机制不到位等问题。为进一步活跃排污权交易市场,山西省继续研究开展排污权抵押贷款和租赁工作,创造性的提出了“排污权自主价格交易”模式,并建议适时拓展新的交易主体、确定排污权“准物权”的属性。Although measures have been taken to enliven the emission rights trading market in Shanxi Province through various methods,including the scientific establishment of emission rights trading market,the trans-regional trading,the adjustment of benchmark price,the reduction of transaction fees,and the simplification of transaction declaration,the effect for the measures taken is not obvious,as the problems,such as obvious administrative acts,insufficient independent participation of enterprises,and inadequate transaction price formation mechanism,are still existed.So in order to further enliven the emission rights trading market,and through continuously studying and conducting regarding of the mortgage loan and lease of emission rights,the innovative“independent price trading of emission rights”is put forward in Shanxi Province,while it is suggested that new trading subjects should be expanded and the attribute of“quasi-real right”of emission rights should be determined in due course.
