Humanistic Connotations in Rawls’s Principle of Justice

摘　　要：在罗尔斯看来,正义原则需要消解功利主义的倾向,从而建构于对社会契约的遵循。罗尔斯正义原则具有三个方面的人学内涵:其一,人的平等与自由是平等的公民自由;其二,假定的“无知之幕”即人的原初状态是对人的存在方式的一种自然而自在的认可;其三,平等地分配基本权利和义务以及偏爱最少受惠者的社会合作体系是个人幸福的前提。罗尔斯视野中的正义原则不乏人文关照意义,对当代资本主义具有深刻的反思性、批判性。Rawls’s principle of justice dispels Benthamism based on social contracts.Rawls views justice as a means of protecting people’s interests.Based on this,Rawls’s principle of justice contains three humanistic connotations:(1)the equality and freedom of people are applicable to citizens;(2)the assumed veil of ignorance,the original position of human beings,is a recognition of human’s natural existence;(3)individual happiness is achieved based on the fair allocation of basic rights and responsibilities,and the social cooperation system that pays special care to the least beneficiary.The humanistic connotations in Rawls’s principle of justice can be used to review and criticize contemporary capitalism.However,its effects should not be exaggerated.Socialists’views on justice in the new era should not break down but bring individuals and groups together.
