“入境发展黑社会组织罪”中“黑社会组织”的司法认定标准及其局限

摘　　要：“入境发展黑社会组织罪”的“黑社会组织”,因各国法律(境外地区)规定不同和不够明确、国际法中也没有关于黑社会组织的具体规定等原因,既难以适用外国法(境外法)标准进行司法认定,也难以适用国际法标准进行司法认定。同时,因我国刑法没有规定黑社会组织的实质认定条件,适用国内法标准进行司法认定也缺乏理论和法律依据。即便是我国刑法今后规定了“黑社会组织”的认定条件,也与“入境发展黑社会组织罪”中的“境外的黑社会组织”存在难以解决的矛盾和冲突。“入境发展黑社会组织罪”设置不科学,建议废除。Because of the different and unclear laws and regulations of various countries(overseas regions)and the lack of specific regulations on the underworld organizations in international law,the“Underworld Organizations” with the crime of entering and developing the underworld organizations are difficult to be recognized by applying the standards of foreign laws(overseas laws)and international laws.At the same time,due to the fact that the criminal law of our country does not stipulate the substantive identification conditions of the underworld organizations,attheoretical and legal basis to apply the domestic legal standards for judicial identification is badly needed.Even if the criminal law of our country stipulates the conditions for the identification of“Underworld Organizations”in the future,contradictions and conflicts are still in existence in dealing the“overseas underworld organizations” with the“crime of entering and developing underworld organizations”.The establishment of the crime of entering and developing the underworld organization is unscientific,so it is suggested to abolish it.
