摘　　要：随着时代的发展,口述史的关注点逐渐聚焦于敏感主题。由于敏感主题的私密性高,导致口述史实践工作不得不面临伦理与司法的双重考验。作者深入分析"麦康维尔谋杀案"和"波士顿学院口述史—贝尔法斯特项目"两个案例所涉及的法律和伦理问题及其冲突,并在此基础上提出了如何规避伦理与司法冲突的建议。With the development of the times,the focus on the sensitive topic is becoming attractive.Because of the high privacy of sensitive topics,the staff in practices of oral history have to face double test of legal and ethics.On the basis of analyzing the legal,ethic questions and their conflicts about the cases of“Murder of Jean McConville”and“Boston College Oral History Belfast Project”,the author gives some advice about how to avoid the conflicts between ethics and justice in sensitive oral history.
