吧国公堂的审案类别及特点研究——以《公案簿》为中心

摘　　要：18世纪末,荷兰殖民地巴达维亚的华人社会事务主要由当地华人建立的吧国公堂进行处理。整理、归纳吧国公堂的审案记录《公案簿》,发现吧国公堂审案具有以中国传统文化为核心,受审案官个人阅历影响,同时在特定领域学习参考荷兰法律的特点。At the end of the 18th century,the Chinese social affairs of the Dutch colony of Batavia were mainly handled by the Batavia Tribunal,which was established by the local Chinese.The sorting and summarizing the trial records of the Batavia Tribunal—The Public Case Book,revealed that the trails of the Batavia Tribunal had the characteristics of taking Chinese traditional culture as the core,while referring to the personal experience of the adjudicator and the Dutch law in specific fields.
